General conditions of sale and use

Preamble

The seller is a manufacturer of acoustic treatment products sold under the brand name PYT audio.
These products are intended for individual customers and professionals.
The products and services marketed by the seller can be consulted on the website: PYTaudio.com as well as on its product catalogue.

Article 1: Purpose

The present General Terms and Conditions of Sale determine the rights and obligations of the parties within the framework of the online sale of products offered by the seller.
The seller undertakes to provide the products and services purchased through its website.
The customer undertakes to respect the conditions of use of the product.

Article 2: General provision

These General Terms and Conditions of Sale (GTS) apply to all sales of products, made through the company’s websites, which are an integral part of the contract between the Buyer and the Seller. The Seller reserves the right to modify the present terms and conditions at any time by publishing a new version on its website. The GTC then applicable are those in force on the date of payment (or the first payment in case of multiple payments) of the order. The company also makes sure that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The customer declares having read all of these GCS, and if necessary the special conditions of sale linked to a product or service, and accept them without restriction or reserve. The customer acknowledges that he or she has benefited from the advice and information necessary to ensure that the offer meets his or her needs. The seller disclaims all liability related to the improper use or application of the products sold. The customer declares to be in a position to contract legally under French law or validly represent the natural or legal person for which he is committing himself. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 3: Prices

The prices of the products and services sold through the websites are indicated in Euros excluding taxes as VAT is not applicable, article 293 B of the General Tax Code.
The prices are indicated excluding specific shipping costs. For all products shipped outside the EU and/or DOM-TOM, the price is also exclusive of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the seller. They shall be borne by the buyer and are his responsibility (declarations, payment to the competent authorities, etc.). The seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities. The company reserves the right to modify its prices at any time in the future. The telecommunication costs necessary to access the company’s websites are to be paid by the customer. Where applicable, delivery costs are also payable by the customer.

Article 4: Conclusion of the online contract

The customer will have to follow a series of steps specific to each product offered by the seller in order to complete his order. However, the steps described below are systematic:

  • Information on the essential characteristics of the products
  • Choice of product
  • If applicable, these options and indication of the customer’s essential data
  • Acceptance of these General Terms and Conditions of Sale
  • Checking of the control elements and, if necessary, correction of errors
  • Follow-up of payment instructions
  • Payment of products
  • Delivery of products

The customer will then receive confirmation by e-mail of the payment of the order, as well as an acknowledgement of receipt of the confirming order. He will receive a .pdf copy of these GCS. For the products delivered, this delivery will be made to the address indicated by the customer. For the purposes of proper completion of the order, and in accordance with Article 1316-1 of the Civil Code, the Customer undertakes to provide his true identification details. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith, or for any legitimate reason.

Article 5: Products and services

The essential characteristics of the goods, services and their respective prices are made available to the buyer on the company’s websites. The performance characteristics of the products are values given as an indication under test conditions established by the company PYTaudio. These values have no contractual value. Some products are produced specifically and exclusively for the customer. The customer agrees to waive his right of retraction on the manufacture and design of the products reserved to him. In addition, the customer accepts the delays and delays related to the supply and manufacturing hazards of its products. The customer certifies having received a detail of the delivery costs as well as the terms of payment, delivery and execution of the contract. The Seller undertakes to honour the Customer’s order within the limits of available Product stocks only. Failing this, the Seller shall inform the Customer of the delays, availability or impossibility of fulfilling the order in full. This contractual information is presented in detail and in French language. In accordance with French law, they are the subject of a summary and a confirmation when the order is validated. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. Except under special conditions, the rights granted hereunder are only granted to the natural person signing the order (or the person holding the email address provided). In accordance with the legal provisions regarding conformity and hidden defects, the seller undertakes to reimburse or replace defective products after their inspection by the after-sales service. Products bearing traces of excessive or inappropriate use of the product will not be refunded or replaced, the reasons for refusal will be explained by the after-sales service.
The product may then be returned to the customer at his request and at his expense.

Article 6: Retention of title clause

The products remain the property of the company until full payment of the price.
The products having been made available to the customer for specific tests under its own conditions of use are the subject of a deposit cheque. PYT audio reserves the right to cash this deposit if the customer does not return all the products in their original condition. In the event that products are damaged and the deposit cheque cashed, the payment of the price of the damaged products will engage the refund of the deposit cheque.

Article 7 : Delivery terms

The products are delivered to the delivery address that was indicated at the time of the order. The delivery time does not take into account the order preparation time. When the customer orders several products at the same time, these may have different delivery times. Their delivery will be made according to the immediate availability of the ordered products. The Seller reserves the right not to ship the order partially if the supply of the remaining products does not exceed 4 weeks. In the event of a delay in shipment, the Seller shall inform the customer and propose a partial delivery as well as a new shipment date for the remaining products. In the event of late delivery, the customer has the possibility of cancelling the contract under the conditions and terms defined in article L138-2 of the Consumer Code. The seller shall reimburse the product and the “outward” expenses under the conditions of Article L 138-3 of the Consumer Code.

In the case where the customer has validated an order for exclusive products, and as Article 5: “products and services” provides, orders for specific products cannot be cancelled for these reasons

Article 8: Availability and presentation

Orders will be processed within the limits of our available stocks or subject to stocks available from our suppliers. In the event of unavailability of an article for a period exceeding 6 working days, you will be immediately informed of the foreseeable delivery times and the order of this article may be cancelled on request. The customer will then be able to ask for a credit note for the amount of the article or its refund.

Article 9 : Payment

Payment is due immediately upon ordering, including for pre-ordered products. The customer may pay by credit card, bank transfer or cheque. Cards issued by banks domiciled outside France must be international bank cards (mastercard or visa). The secure online payment by credit card is made by our payment provider (Systempay – Banque Populaire). The information transmitted is encrypted according to the rules of art and cannot be read during transport on the network. Once the payment is initiated by the customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information at the time of the sale, the Customer authorizes the seller to debit his card for the amount corresponding to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the sale is immediately cancelled by operation of law and the order is cancelled. In the event that the order is subject to a deposit, the seller reserves the right to ship the goods only after full payment has been made.

Payment Option Free Credit CHOOZEO

CHOOZEO is a free credit with no fees, repayable in 3 or 4 installments, offered by BPCE FINANCEMENT, a French public limited company with capital of €73,801,950 – Head office: 30 avenue Pierre Mendès France 75013 – 439 869 587 RCS Paris. The amount of the free credit varies between €135 and €3,000.

CHOOZEO is reserved for private individuals (natural persons of legal age) residing in France and holders of a Visa or MasterCard with a validity date 4 months higher than the date of purchase. CHOOZEO does not accept cards with systematic authorization, such as Electron, Maestro, Nickel etc… as well as e-cards, Indigo and American Express cards. After completing the order, the customer must click on the “CHOOZEO 3 or 4 CHOOZEO credit card payment button”. He is then redirected to the CHOOZEO web page of BPCE FINANCEMENT displaying the summary of his order and the request for free credit, which he must then validate. PYT Audio limits itself to putting its customers in contact with BPCE FINANCEMENT by indicating on its site a non-contractual landing page. It is therefore not subject to the regulations relating to intermediaries in banking operations and payment services.
In addition, if the customer requests to benefit from a financing solution offered by BPCE FINANCEMENT, information relating to his order and his identity (surname, first name, postal address) will be sent to him. BPCE FINANCEMENT will use this information for the purpose of studying his application for the granting, management and collection of credit.

BPCE FINANCEMENT reserves the right to accept or refuse its application for financing in 3 or 4 installments at no charge. The customer has a cooling-off period of 14 calendar days to renounce his free credit.
